NATIONAL ENSURES LOCAL'S ARBITRATION VICTORY STICKS
(May 2, 2007)
The Borough of Oakmont in PA thought it could bully and spend into extinction Local 211 with a membership of only 23. They weren't counting on the National Union.
When the Borough fired a 26-year member of Local 211 for refusing to be harassed about providing medical information, the Local knew it had no choice but to support such a long-term employee. And indeed they did a great job, winning the arbitration in stunning style, with the arbitrator forcing the Borough to restore the member with full back pay.
Not satisfied with having lost the arbitration in stunning style, the Municipality appealed the case to the Common Pleas Court where the local made sure they went down in flames once more. Still trying to rise like a phoenix from the ashes, the Borough appealed to State Court, no doubt hoping the local would simply run out of money.
Indeed they had. But the National Union stepped in and used the power of our 50,000 members to protect one very senior member. On the Ides of March, 2007, more than 2 years after he was fired, Paul Walters and Local 211 were finally vindicated by the state court. And Paul returned to work a few days later. It is a good lesson for other small employers-Nationwide we stand as one! |
